Reference to any NFT products, services, processes or other information by name, trademark, manufacturer, supplier or otherwise on this platform does not constitute or imply endorsement, sponsorship, or recommendation by Xsolla ZK, Inc. (“Xsolla ZK”). Xsolla ZK does not have ownership, custody or control of NFTs or any smart contracts deployed by third parties. Creators of NFT products listed on this platform are solely responsible for NFT product operation and functionality.

Nature of NFTs: These NFTs are for entertainment purposes only and may include digital assets such as artwork, designs and drawings. By purchasing an NFT on this platform, you are acquiring only a license to the NFT and not acquiring the intellectual property rights associated with the NFT. Your purchase or use of the license granted herein (to you or a third party you contract with) signifies your acknowledgment of the terms of this Disclaimer, which are hereby incorporated into Xsolla ZK’s End-User License Agreement (“EULA”).

Indemnity and Limitation of Liability: You agree to indemnify, defend and otherwise hold harmless Xsolla ZK, its owners, officers, directors, employees, members, shareholders and affiliates against any claims, liability, costs, damages or expenses arising out of your use of Xsolla ZK Software. To the maximum extent permitted by law, you agree that the maximum amount that you may claim as compensation, damages, etc., against Xsolla ZK is the amount that you have paid to Xsolla ZK for the specific transaction(s) that is subject to this Disclaimer.
